หลักความเสมอภาคในการรับบริการสาธารณะกับองค์การมหาชนในประเทศไทย

บทคัดย่อ
บทความนี้มุ่งศึกษาถึงหลักการพื้นฐานและหลักเกณฑ์ของหลักความเสมอภาค ซึ่งเป็นหลักกฎหมายทั่วไป มีหลักเกณฑ์สำคัญให้ต้องปฏิบัติต่อบุคคลให้เหมือนกันในสาระสำคัญอย่างเดียวกัน และปฏิบัติต่อบุคคลให้แตกต่างกันในสาระสำคัญที่แตกต่างกันออกไปตามลักษณะเฉพาะของแต่ละคน การปฏิบัติต่อบุคคลให้เหมือนกันในสาระสำคัญที่แตกต่างกันจึงเป็นความไม่เสมอภาค และศึกษาถึงสาระสำคัญของหลักความเสมอภาคในการรับบริการสาธารณะ ซึ่งมีขึ้นเพื่อให้การจัดทำบริการสาธารณะเป็นไปเพื่อประโยชน์ของประชาชนอย่างเท่าเทียมกัน โดยต้องพิจารณาทั้งในด้านผู้รับบริการและในด้านผู้ให้บริการ รวมทั้งศึกษาถึงหลักการและหลักเกณฑ์ของการจัดทำบริการสาธารณะ ซึ่งเป็นหลักสำหรับการปฏิบัติหน้าที่ของรัฐ มีหลักเกณฑ์สำคัญให้ต้องจัดทำด้วยความเสมอภาค มีความต่อเนื่อง และมีการปรับปรุงเปลี่ยนแปลงให้เหมาะสม ตลอดจนศึกษาถึงลักษณะเฉพาะขององค์การมหาชน ซึ่งเป็นหน่วยงานของรัฐ มีความเป็นอิสระ ถูกออกแบบมาเพื่อปฏิบัติภารกิจในการจัดทำบริการสาธารณะเฉพาะด้านสังคมและวัฒนธรรม โดยคาดหวังประสิทธิภาพในการบริหารจัดการและการดำเนินภารกิจ โดยพิจารณาถึงความสัมพันธ์และความเชื่อมโยงกันของหลักความเสมอภาคในการรับบริการสาธารณะกับองค์การมหาชนในประเทศไทยในมิติของความผูกพัน มิติของการปรับใช้หลักการ และมิติของผลกระทบ จากการศึกษาพบว่า (1) หลักความเสมอภาคในการรับบริการสาธารณะกับองค์การมหาชนในประเทศไทยผูกพันตามกฎหมายอย่างเป็นระบบ ทั้งในฐานะหลักกฎหมายทั่วไป ในฐานะหนึ่งในหลักเกณฑ์สำคัญของหลักการจัดทำบริการสาธารณะ ในฐานะหนึ่งในหลักการบริหารกิจการบ้านเมืองที่ดี และในฐานะหนึ่งในมาตรฐานจริยธรรมสำหรับคณะกรรมการ ผู้บริหาร เจ้าหน้าที่ และผู้ปฏิบัติงานในองค์การมหาชน (2) มีการปรับใช้หลักการนี้กับการปฏิบัติภารกิจขององค์การมหาชนบ้างแล้ว และส่งผลกระทบในเชิงบวกสอดคล้องกับความผูกพันตามระบบอย่างชัดเจน และ (3) มีข้อสังเกตถึงการยังไม่ปรับใช้หลักการนี้ ซึ่งส่งผลกระทบในเชิงลบให้ไม่สอดคล้องกับความผูกพัน โดยอาจมีสาเหตุจากการขาดความรู้ ความเข้าใจ ขององค์การมหาชน ดังนั้น เพื่อให้การบังคับใช้กฎหมายมีประสิทธิภาพสอดคล้องกับความผูกพันตามระบบ จึงสมควรสร้างและ/หรือให้ความสำคัญกับความรู้ ความเข้าใจ และการปรับใช้หลักความเสมอภาคในการรับบริการสาธารณะกับความเป็นองค์การมหาชนในประเทศไทยให้กับผู้เกี่ยวข้องกับองค์การมหาชน
