THE PROBLEMS OF LAW ENFORCEMENT FOR THE WETLANDS MANAGEMENT AND CONSERVATION : THE CASE STUDY OF KA-CHING SWAMP FOREST, PATEW, CHUMPON PROVINCE

Abstract

   

This study intended to 1) study the trespassing problem, 2) explore the extent and enforcement of the legislation by central and regional government organizations in swamp forest management and conservation and 3) recommend the legal measure facilitating management and conservation in Ka Ching Swamp Forest, Pa Tew, Chumporn Province. The researchers employed qualitative methods including content analysis and in-depth interviews in the data collection. The key informants were 4 representatives from central and regional government organizations; 5 representatives from sub-district administrative organization, the president and staff; and 50 locals filling in the questionnaires. Mile and Huberman was used in data analysis.

            It is found that 1) the central and regional government organizations have been enforcing the prescribed legislation, 2) local administrative organization and residents realized the important of the swamp forest as their habitat and source of food. Nevertheless, some groups of participants mentioned that the management and conservation under the enforced legislation obstructed the locals in terms of habitat and generating income; this led to the conflict between them and government officers. To achieve the objective of this study in promoting effective management and conservation in the field area, the researchers hereby recommended the legislation to promote Ka Ching as the role model of collaboration between government sector and community in swamp forest management and conservation; this as a result would efficiently enhance the enforcement of the legislation in swamp forest management and conservation in the area.
