การรับจ้างและการว่าจ้างทำดุษฎีนิพนธ์ : การละเมิดกฎหมายอย่างร้ายแรงที่มีทั้งโทษปรับและจำคุกหรือทั้งจำทั้งปรับ

เงื่อนไขสำคัญยิ่งประการหนึ่งในการสำเร็จการศึกษาระดับปริญญาเอกคือการทำดุษฎีนิพนธ์ได้สำเร็จและผ่านการสอบปกป้องดุษฎีนิพนธ์โดยคณะกรรมการ ทั้งนี้การทำดุษฎีนิพนธ์นักศึกษาต้องดำเนินการจัดทำด้วยตนเองตั้งแต่ต้นจนจบตามกระบวนการวิจัย โดยอยู่ภายใต้การควบคุมของอาจารย์ที่ปรึกษา อย่างไรก็ตามได้ปรากฏอย่างชัดแจ้งว่ามีการโฆษณารับจ้างทำดุษฎีนิพนธ์ผ่านสื่อต่าง ๆ โดยเฉพาะสื่อสังคมออนไลน์ ทั้งนี้การรับจ้างและการว่าจ้างทำดุษฎีนิพนธ์ เป็นการกระทำที่ผิดกฎหมายซึ่งมีโทษร้ายแรงทั้งทางแพ่งและทางอาญา กล่าวคือมีโทษปรับหรือจำคุกหรือทั้งจำทั้งปรับ บทความนี้ มีวัตถุประสงค์ที่จะนำเสนอประเด็นการรับจ้างและว่าจ้างทำดุษฎีนิพนธ์ อันเป็นการกระทำผิดกฎหมายฉบับใหม่ที่ออกมาในปี 2562 ซึ่งมีโทษอย่างร้ายแรง เพื่อเผยแพร่แก่ชุมชนวิชาการได้รับทราบให้กว้างขวางมากขึ้น สาระสำคัญของบทความนี้ประกอบด้วย 1) บทนำ เพื่อแนะนำความสำคัญของปัญหาและสาระสำคัญของบทความ 2) การจัดการเรียนการสอนระดับปริญญาเอก 3) ความสัมพันธ์ระหว่างการเรียนการสอนระดับปริญญาเอกกับดุษฎีนิพนธ์ 4) การรับจ้างและการว่าจ้างทำดุษฎีนิพนธ์ 5) กฎหมายและบทกำหนดโทษการรับจ้างและการว่าจ้างทำดุษฎีนิพนธ์ และ 6) สรุปและเสนอแนะ
