Penal Order Procedure under German Criminal Procedural Law

Abstract
The penal order procedure is an entirely written procedure, conducted without a trial or any appearance of the accused before a court. If the defendant does not object to the penal order, the case can be swiftly concluded. German, Swiss, and French laws stipulate such proceedings as outlined in their criminal procedure codes. In contrast, if the accused objects, the penal order becomes ineffective, and a regular criminal trial takes place, as if the penal order had never been issued. Despite their merits, these proceedings have some disadvantages that the author will discuss, primarily focusing on the guidelines of German law. Swiss and French laws will be used to supplement the author’s proposal. Initially, the author suggests that such proceedings be applied to fine-only offences under the Fine-Only Offences Act of B.E. 2565 before being extended to more serious criminal offences.
