Law Philosophy in the Thai Criminal Law System and Buddhist Ethics on Patience

Abstract

This academic article is aimed to study about Law Philosophy in the Thai Criminal Law System and Buddhist Ethics on Patience. The study shows that the first Sĩla, to refrain from killing, is one of the basic principle in Buddhism but this principle is more complex than the understanding of most Buddhists. The diagnostic concepts, for one who breach this Sĩla and the severity of breaching it in different ways, have more details than the concepts in common Buddhists’mind. The study about the comparation of Buddhism philosophy and philosophy of law, which is on the background of Thai criminal law system, about this matter have found that the ethics issues of the both system of philosophy are significantly according to each other. The thinking system of both philosophies originated from different places, point of times and ways of motivation. The surprising similar principle of both system of philosophy shows that wisdoms, contemporaries and logic of Buddha’s philosophy should be classified in the same level of philosophy of law in criminal law, which is highly accepted worldwide. Buddhism philosophy is one of the philosophy system that should study along with others, this study also suggests.
