แนวคิดทางกฎหมายเพื่อการจัดการปัญหาความไร้รัฐไร้สัญชาติ ในอำเภอวังทอง จังหวัดพิษณุโลก

บทคัดย่อ
บทความฉบับนี้ ผู้เขียนมีจุดมุ่งหมายเพื่อนำเสนอข้อค้นพบจากการสำรวจสถานการณ์ปัญหาความไร้รัฐไร้สัญชาติ ในพื้นที่อำเภอวังทอง จังหวัดพิษณุโลก ในกิจกรรมห้องเรียนสิทธิมนุษยชนเคลื่อนที่ ครั้งที่ 12-14 ตั้งแต่กันยายน พ.ศ. 2559 - พฤศจิกายน พ.ศ. 2560 ภายใต้โครงการคลินิกกฎหมายนเรศวร (เพื่อสิทธิมนุษยชน) คณะนิติศาสตร์ มหาวิทยาลัยนเรศวรซึ่งจัดขึ้นโดยอาศัยความร่วมมือขององค์กรภาคีเครือข่ายทั้งภาครัฐและเอกชนในพื้นที่ ซึ่งปรากฏข้อค้นพบเบื้องต้น 5 ประการ กล่าวคือ
ประการแรก พบว่ามีบุคคลไร้รัฐไร้สัญชาติในอำเภอวังทอง อย่างน้อย 294 คน จำแนกเป็น 2 กลุ่ม คือ (1) บุคคลไร้รัฐไร้สัญชาติที่อยู่ในสถานคุ้มครองคนไร้ที่พึ่ง ประมาณ 200 คน และ (2) บุคคลไร้รัฐไร้สัญชาติที่อยู่นอกสถานคุ้มครองคนไร้ที่พึ่ง ประมาณ 94 คน ซึ่งสามารถจำแนกตามลักษณะปัญหาความไร้รัฐไร้สัญชาติได้ 2 ลักษณะ คือ คนไร้รัฐไร้สัญชาติโดยข้อเท็จจริง และคนไร้รัฐไร้สัญชาติโดยข้อกฎหมาย นอกจากนี้ ยังสามารถจำแนกสภาพปัญหาความไร้รัฐไร้ สัญชาติโดยพิจารณาจากจุดเกาะเกี่ยวของบุคคลกับรัฐไทยได้เป็น 2 ประเภท คือ (1) บุคคลที่มีจุดเกาะเกี่ยวกับรัฐไทยโดยการเกิด โดยหลักบุคคลเพราะมีบุพการีและญาติพี่น้องสัญชาติไทย หรือโดยหลักดินแดนเพราะเกิดในดินแดนของรัฐไทยหรืออาศัยอยู่และปรากฏตัวในรัฐไทย มาเป็นเวลานาน และ (2) บุคคลที่มีจุดเกาะเกี่ยวกับรัฐไทยภายหลังการเกิด ทั้งโดยหลักบุคคลและหลักดินแดน
ประการที่สอง พบว่าความไร้รัฐไร้สัญชาติของบุคคลในพื้นที่อำเภอวังทอง มีสาเหตุมาจาก บิดามารดา ตัวเจ้าของปัญหา ภาคเอกชนที่ให้ความช่วยเหลือ เจ้าหน้าที่รัฐที่เกี่ยวข้อง รวมถึงปัจจัยภายนอกอื่นๆ ได้แก่ การโยกย้ายถิ่นฐาน การเดินทาง รวมถึงปัญหาเศรษฐกิจและปัญหาสังคม
ประการที่สาม พบว่าบุคคลไร้รัฐไร้สัญชาติในวังทองต้องเผชิญกับปัญหาในการเข้าถึงสิทธิด้านต่างๆ ที่จำเป็นต่อการดำรงชีวิต อาทิ สิทธิในการรักษาพยาบาล สิทธิในการศึกษา สิทธิในการประกอบอาชีพ สิทธิในการอาศัยอยู่ในรัฐไทย สิทธิในการเดินทาง สิทธิในการก่อตั้งครอบครัว เป็นต้น
ประการที่สี่ พบแนวทางในการขจัดปัญหาสถานะบุคคล (1) ขจัดความไร้รัฐโดยกฎหมายการทะเบียนราษฎร (2) ขจัดความไร้สัญชาติโดยกฎหมายสัญชาติของไทย
ประการที่ห้า พบว่ากระบวนการทำงานเพื่อการขจัดปัญหาความไร้รัฐไร้สัญชาติที่มีประสิทธิภาพและสัมฤทธิ์ผลจะเกิดขึ้นได้ด้วยการมีส่วนร่วมจากเจ้าของปัญหา รวมถึงหน่วยงานที่มีส่วนเกี่ยวข้อง ทั้งหน่วยงานภาครัฐ/ภาคราชการ หน่วยงานภาคเอกชน/ภาคประชาชนและภาควิชาการ
