Abstract

       The purpose of this research were to study the judge’s opinion toward probation Act 2016. The sample of this study were judge from provincial court in region I, method of indepth interview 10 judge who were period of holding judge over 5 years, by accidental sampling and observation technique was also used in case study in court.

       Result of this study majority of judge 90% agree with pre-sentence investigation report by probationer, 70% the judge agree with suggestion’s probationer on the condition of probation. 70% the judge agree with they can refer the offender to work public service by law. 90% the judge agree with probationer are trained by social case work which the application of scientific method of helping offender and recommend suitable plans and supervision the offenders to return them to their community as a good citizen. Selection volunteer every judge  agree with careful selected volunteer from community.The qualified volunteer is very importance for probation. The court have final authority and responsibility for this position in all case. Final conclusion, majority of judges 80% agree with probation department is under supervision of judicial court
