The Offense of Defamation and Proving the Truth: Comparative Study of the Federal Republic of Germany

Abstract
The purpose of this academic article is to compare the determination of liability for defamation under the Criminal Code of Thailand and the Federal Republic of Germany. On the issue of stating truthful statements and causing damage to others, Thailand has defined the form of defamation as saying the truth or falsehood that causes the victim to be considered an offense. In the Federal Republic of Germany, the form of defamation offense is limited only to false statements.
This article is in the form of a quality script by researching information from online documents and various websites both in Thailand and abroad. Theories and legal reasons for enacting the offense of defamation and proving the truth in both of Thailand and the Federal Republic of Germany.
