การวิจัยนี้มีวัตถุประสงค์เพื่อศึกษาพัฒนาการ มาตรการ และแสวงหาแนวทางแก้ไขปัญหาขายฝากผูกโยงกับราคารับซื้อฝากที่ดินและอสังหาริมทรัพย์ในประเทศไทย เป็นการวิจัยเชิงคุณภาพด้วยวิธีวิจัยเชิงเอกสาร ใช้แบบสังเคราะห์กฎหมายขายฝากที่มีค่าความสอดคล้องกับเนื้อหาเท่ากับ 0.82 เก็บรวบรวมข้อมูลจากแนวคิดทฤษฎีเกี่ยวกับหลักกฏหมาย หลักการว่าด้วยหนี้ หลักการของสัญญา หลักการของสัญญาขายฝาก หลักกฎหมายทั่วไป พัฒนาการของกฎหมายขายฝากในประเทศและต่างประเทศ และบริบทปัญหาเกี่ยวกับการขายฝากที่ดินและอสังหาริมทรัพย์ วิเคราะห์ข้อมูลโดยการแยกแยะเนื้อหา ตีความกฎหมาย และสรุปแนวทาง นำเสนอด้วยวิธีพรรณนาบรรยายและตารางประกอบ
ผลการวิจัยพบว่า โดยภาพรวมของพัฒนาการกฎหมายขายฝากในประเทศไทยและต่างประเทศ มีความคล้ายคลึงกัน ซึ่งกฎหมายขายฝากที่ดินและอสังหาริมทรัพย์ของประเทศไทยที่บังคับใช้ในปัจจุบัน ไม่อาจตอบสนองต่อระบบเศรษฐกิจทุนนิยมที่ทำให้เกิดหนี้นอกระบบ ส่งผลให้เกิดวิกฤตการณ์สูญเสียที่ดินและอสังหาริมทรัพย์อย่างต่อเนื่อง และแนวทางการแก้ไขที่ค้นพบคือ การปรับปรุงกฎหมายขายฝากที่ดินและอสังหาริมทรัพย์ โดยให้มีมาตรการทางกฎหมายด้านเกณฑ์ควบคุมราคารับซื้อฝากขั้นต่ำสุดที่คู่สัญญาพึงตกลงซื้อขายกันได้ ด้วยการเทียบราคาประเมินตามมาตรฐานกลางของกรมที่ดิน และด้านการกำหนดเวลาขายฝากที่เชื่อมโยงกับราคารับซื้อฝาก ด้วยการกำหนดกรอบระยะเวลาขั้นต่ำสุดไว้เป็นมาตรการบังคับโดยนำราคารับซื้อฝากมาเป็นข้อพิจารณาประกอบเป็นข้อสาระสำคัญ เพื่อรักษาไว้ซึ่งความสมดุลแห่งสิทธิความยุติธรรมในทางประโยชน์แห่งสังคม ที่สามารถตราขึ้นเป็นพระราชกฤษฎีกา ระเบียบ หรือข้อบังคับ เพื่อเป็นแนวทางปฏิบัติในลักษณะกฏหมายลูกต่อไป
