Roles and Duties of Committee of Special Case Inquiry Officials under the Special Case Investigation Act B.E. 2547 (2004)

Abstract

This research aimed to study the roles and duties of the Special Case Investigation Officer’s Committee (OBEC) under the Special Case Investigation Act B.E. 2547 (2004) and the problems in the disciplinary process. Issues in the practice of not promoting the annual salary for the Special Case Inquiry Officials under Section 37 (2) and (3) of the Special Case Investigation Act B.E. 2547 (2004)  not postpone the annual salary of the Special Case Inquiry Officer and disciplinary proceedings only by studying the relevant concepts and theories and comparing them with the organization that is similar to the board of directors in the Department of Special Investigation including domestic organizations and foreign To point out the form and appropriate nature of the organization structure for special investigations under the Special Investigation Act.

The study found that: the Committee of Special Case Inquiry Official (CISO), with members from outside the agencies, was the majority of the members. Accordingly, the Committee is legally assigned to consider the said matters before the issuance of administrative orders by the authorized officers. However, this provision in section 37 does not give the Committee the power to enforce, and the supervisors are not obliged to comply with the opinions of the Committee. Instead, the superiors authorized to issue administrative orders must comply with resolutions of the Civil Service Commission Common Subcommittee following the Civil Service Act, B.E. 2551 (2008), which comprises the agency’s internal members as the majority of the members. Consequently, it renders the Committee of Special Case Inquiry Officials (CISO) powerless or unable to protect the notable case inquiry officials as intended. Therefore, we should amend the law in respect of the provision above by stipulating a legal requirement to improve the composition and increase the power of the Committee of Special Case Inquiry Official (CISO) to supersede those of the Civil Service Commission Common Subcommittee as well as to reduce the steps to a proper lever in order
