The Legal Measures relating to Control of Healthcare Professionals Collaborating in Product Advertisement A Case Study of Advertising through Digital Terrestrial Television Programs in Thailand

Abstract

This article examines (1) the standard guidelines for advertising health products on terrestrial digital television by medical professionals who are involved in or appear in the advertisements, and (2) the laws and penalties related to controlling the advertisement of health products on terrestrial digital television by medical professionals who are involved in or appear in such advertisements. The study is based on documents, theses, journals, articles, and other materials. The results indicate that (1) the standard guidelines for advertising health products on terrestrial digital television by medical professionals who are involved in or appear in such advertisements vary across countries, depending on their laws and policies. Measures are taken progressively, starting from issuing warnings to the medical professionals and recording their history of exploiting consumers, to administrative orders or penalties that could impact the renewal of their licenses. (2) Regarding the laws and penalties related to controlling the advertisement of health products on terrestrial digital television by medical professionals, policies and penalties vary across different countries. However, it is noted that other countries place significant importance on protecting consumer rights and recognize the problem of exaggerated claims in advertisements. In terms of consumer protection in advertising in Thailand, the Medical Profession Act B.E. 2525 (1982) remains the only law addressing medical professionals to date, but it does not stipulate any regulations, prohibitions, or legal measures regarding advertisements, product reviews, or endorsements of health products by medical professionals, whether on television or other media. Additionally, there are no penalties or fines for cases of exaggerated product claims in advertisements.
