การทำประชามติเพื่อแยกตัวออกจากรัฐและสถานะความเป็นรัฐของดินแดนที่แยกตัว

บทคัดย่อ
ในทางกฎหมายระหว่างประเทศ การทำประชามติมักจะถูกกล่าวถึงควบคู่กับสิทธิกำหนดเจตจำนงด้วยตนเองในบริบทของการที่ดินแดนหนึ่งต้องการแยกตัวออกจากรัฐเดิม โดยการทำประชามติในบริบทดังกล่าวมีสถานะเป็น “เครื่องมือ” ของการใช้สิทธิกำหนดเจตจำนงด้วยตนเองว่าต้องการแยกตัวออกมา กล่าวคือ การทำประชามติไม่ได้ก่อให้เกิดสิทธิในการกำหนดเจตจำนงเพื่อการแยกตัว จะสามารถใช้สิทธิกำหนดเจตจำนงเพื่อนำไปสู่การแยกตัวหรือไม่นั้นยังคงขึ้นอยู่กับกฎหมายระหว่างประเทศที่เกี่ยวข้อง ในกรณีที่กฎหมายระหว่างประเทศให้สิทธิกำหนดเจตจำนงเพื่อแยกตัวเพียงอย่างเดียวไม่ได้เพียงพอต่อการอ้างว่า การแยกตัวนั้นชอบด้วยกฎหมายแล้วเสมอไป เนื่องจากการทำประชามติในฐานะเครื่องมือของการใช้สิทธิกำหนดเจตจำนงเพื่อแยกตัวนั้นจะต้องชอบด้วยกฎหมายด้วย ด้วยเหตุดังกล่าว บทความนี้จะกล่าวถึงหลักเกณฑ์ที่จะทำให้การทำประชามติเพื่อแยกตัวนั้นชอบด้วยกฎหมายระหว่างประเทศ และเนื่องจากดินแดนที่แยกตัวออกมามักจะถูกตั้งคำถามถึงสถานะความเป็นรัฐของดินแดนนั้น ๆ บทความนี้จึงรวมถึงหลักเกณฑ์การพิจารณาสถานะความเป็นรัฐของดินแดนที่ได้แยกตัวออกมา อาศัยการวิเคราะห์ตราสารระหว่างประเทศ หลักกฎหมายจารีตประเพณี และกรณีศึกษาไครเมีย ค.ศ. 2014 ซึ่งพบว่า ความชอบด้วยกฎหมายของประชามติเพื่อแยกตัวต้องผ่านการพิจารณาสองชั้น ชั้นแรกคือ ฐานสิทธิตามกฎหมายระหว่างประเทศที่รองรับการแยกตัวนั้น และชั้นที่สองคือ กระบวนการทำประชามติที่เป็นไปตามหลักเกณฑ์ทางปฏิบัติ นอกจากนี้ แม้ประชามติจะชอบด้วยกฎหมาย ดินแดนที่แยกออกมาก็ยังต้องผ่านการพิจารณาองค์ประกอบความเป็นรัฐตามอนุสัญญามอนเตวิเดโอและหลักความชอบธรรมทางกฎหมายควบคู่กัน กรณีไครเมียเป็นตัวอย่างที่ชัดเจนว่าเมื่อขั้นตอนใดขั้นตอนหนึ่งบกพร่อง ผลทางกฎหมายของการแยกตัวทั้งกระบวนการย่อมถูกปฏิเสธจากประชาคมระหว่างประเทศ
