บทคัดย่อ
ประเทศสาธารณรัฐประชาชนจีนใช้รัฐบัญญัติต่อต้านการแข่งขันที่ไม่เป็นธรรม ค.ศ. 2019 ร่วมกับกฎระเบียบเกี่ยวกับการห้ามการกระทำการอันเป็นการละเมิดความลับทางการค้า ค.ศ. 2006 เพื่อปฏิบัติตามพันธกรณีความตกลงทริปส์ โดยเอกชนเป็นเจ้าของความลับทางการค้า แต่ด้วยความยากลำบากในการปกป้องความลับทางการค้าในอุตสาหกรรมเทคโนโลยีชั้นสูงที่เพิ่มขึ้นอย่างมาก รัฐจึงนำการเยียวยาทางปกครองเข้ามาใช้ และเมื่อมลฑลต่าง ๆ ก็ใช้กฎระเบียบเกี่ยวกับการห้ามการกระทำการอันเป็นการละเมิดความลับทางการค้าของตน ทั้ง ๆ ที่กฎระเบียบเหล่านี้ขัดต่อแนวทางการใช้กฎหมายลำดับรอง ชาวจีนจึงเกิดความสับสนในการใช้กฎหมาย ประเทศไทยจึงสามารถเรียนรู้และหลีกเลี่ยงการบัญญัติกฎหมาย ดังเช่นประเทศสาธารณรัฐประชาชนจีน
