Measures of the Trade Secret Laws of the People’s Republic of China for protection of high-tech products: Experience of The People’s Republic of China in protecting trade secrets

Abstract
In order to comply with The TRIPS Agreement, the People’s Republic of China has implemented the Anti-Unfair Competition Act of 2019 and the Prohibition of Actions in Violating Trade Secrets Regulations of 2006, under which the private sector owns the trade secrets. With the increasing difficulty of trade secrets protection in a high-tech industry, the State has accordingly implemented administrative remedies. Other counties in China have also implemented regulations prohibiting acts that would infringe on trade secrets, even when these regulations conflict with subordinate law enforcement practices. Chinese people are confused about applying the law. Therefore, Thailand can learn and avoid enacting laws like the ones in the People’s Republic of China.
