Liability for Criminal Damage of Protesters: A Case Study of ‘Colston Four’ in England

Abstract

               Public gathering to protest against government is a normal activity in democratic societies. However, some protesters went too far by damaging or destroying properties belonging to another and had been held to account in a criminal court for criminal damage. Are there any lawful excuses available for those accused? This article analyses defences raised by four protesters charged with criminal damage and later acquitted by the jury in the recently decided case in English court widely known as the case of ‘Colston Four’; the case which has been heavily criticized by English lawyers. A comparative analysis with relevant Thai laws reveals that defendants in Colston Four may not be acquitted in Thai courts.
