A Cryptocurrency Payment under the Civil and Commercial Code

Abstract
A cryptocurrency is a digital asset which has grown rapidly. Recently, a cryptocurrency has been used as an investment instrument and a medium of exchange. However, Thailand does not have a specific regulation dealing with cryptocurrency payments. A question arises whether and how a cryptocurrency can really be used as a medium of exchange. The purpose of this research is to determine and analyze whether a cryptocurrency can be used as a medium of exchange and a means of payment under the Civil and Commercial Code. A methodology for doing this research relies on qualitative research. It collects data from books, academic articles, reports, news, regulations, and judgments. These data have been used to determine the legal status of a cryptocurrency. These data have also been used to analyze the scope and possibility of using a cryptocurrency as a medium of exchange and a means of payment under the Civil and Commercial Code.
This research found that a cryptocurrency is not a legal tender. A cryptocurrency may not be used in a transaction or contract which requires a payment under the Civil and Commercial Code. However, a cryptocurrency is property. A cryptocurrency may be used in a transaction or contract which requires or involves the exchange of property. An example may include a barter agreement. In this case, the Civil and Commercial Code: Obligations applies to the delivery of a cryptocurrency.
This research also explores how a cryptocurrency becomes a legal tender. A cryptocurrency would then be used in a transaction or contract which requires a payment. In fact, the Thai government should: (1) revise the “Currency Act B.E. 2501” and allow a cryptocurrency to be used as a legal tender or (2) issue a specific regulation on cryptocurrency payments.
