Judicial Independence : Experience from the Republic of Poland

Abstract

          Judicial independence, which is part of the rule of law, is a guarantee of the performance of judges recognized in all legal systems. These principles include the principle of independence in the performance of duties and the principle of personal independence that guarantees judges that they can perform their duties by the law and their conscience. Having the idea of immunity for judges is another element that will enhance the independence in performing such duties, which the legal system of the Republic of Poland h a s ensured all of these in its constitutional law and the Statute of the Courts of Justice.
