Philosophy of Law in the Middle Ages

Abstract

       Medieval periods (or the Middle Ages) are a period of about a thousand years between the fall of the Roman Empire and the dawn of the Modern era. The term ‘medieval’ is used negatively. It stems from a disinterest encouraged by the popular belief that the medieval period was the Dark Ages. But many consider the Middle Ages to have been a period of germination and growth. This article considers legal philosophy in the Middle Ages, which was dominated by the church and its doctrines. Philosophy of antiquity was not lost; Plato and Aristotle exercised an influence upon the minds of many medieval Christian thinkers. However, the concepts and ideas which the philosophy of antiquity had produced were reinterpreted in the light of the theology and doctrines of the Christian church. Many great thinkers, whose works laid down the framework for subsequent reflection on legal philosophy, born during these periods. These include the following figures: St. Augustine of Hippo. Many Christian thinkers saw some contradictions between Christianity and the philosophy of antiquity. For them, however, the similarity between Plato and the Christian doctrine was so apparent. They particularly pointed out that there are limits to how far reason can get mankind in religious questions. It was thus Christian thinkers who Christianized Plato.
