Abstract
The promulgation of the Act on Measures Preventing Recidivism in relation to Offences Against Sex or Violent Crime B.E. 2565 (JSOC Act) sets out the legal procedures and framework for dangerous offenders in 3 major categories, including (1) sex offenders (2) offenders in offences against life and body (3) offenders in ransom or kidnapping cases. The aim of this paper is to analyze legal measures providing procedures and practices on the classifications of offenders between dangerous offenders and other general offenders. It also considers the rehabilitation measures offered to dangerous offenders, as well as examining legal procedures for post-release monitoring of dangerous ex-offenders in order for them to be well-integrated into the society. This study shows that the JSOC Act created a need for a procedural framework to classify dangerous offenders in a way that would distinguish those deemed violent and dangerous to society from those who general offenders. Its aim is to put such offenders into the suitable and correct rehabilitation processes according to such offenders’ needs. The Law also requires to have legal procedures for post-release monitoring of dangerous offenders. In essence, this paper aims to analyze the effectiveness of its enforcement of such law.
