The Problems of Scamming on the Internet: A Case Study of Romance Scams

Abstract
This research article examines internet deception, specifically the case of romance scams involving fraudulent inducement to transfer money. It focuses on the legal offenses, prescribed penalties, and the regulation of online dating application users. The study found that romance scams are prevalent on online dating applications. Perpetrators often create fake profiles with false personal information and employ psychological techniques related to love to deceive victims into willingly transferring money. Consequently, when examining Thai law, no specific offense addressing this particular type of deception was identified. However, the application of the Penal Code, specifically the offense of fraud, and the Computer-Related Crimes Act B.E. 2550 (2007) and its amendment B.E. 2560 (2017), Section 14, was observed. The results indicate that the elements of these deception offenses have evolved, leading to a situation where the existing laws are not fully comprehensive and inconsistencies arise. This, in turn, hinders the courts' ability to effectively punish offenders. Regarding the regulation of online dating application users, there is currently no clearly designated agency responsible for user protection. As a result, the Royal Thai Police remain the primary agency for investigating and apprehending offenders. This situation leaves users with no alternative channels to seek assistance or receive warnings before or during the process of being scammed. Therefore, this research recommends amending the fraud provisions in the Penal Code and increasing the prescribed penalties. It also proposes the establishment of a specialized agency dedicated to addressing internet deception. This agency would be responsible for implementing assistance measures, providing advice, and serving as an information hub for users. These measures would systematize law enforcement, reduce inconsistencies, and potentially decrease the number of such deception cases to some extent.
