Problems Resulting from the Selection of Senators under the Constitution of the Kingdom of Thailand B.E.2560

Abstract

This research is a qualitative research by using the study method from the primary document which aims to 1) A study of concepts, theories and developments about the Senate 2)A study of concepts and theories on how to acquire senators 3)analyze the problem  of the senator recruitment method and various environmental factors causing problems4) Recommend appropriate guidelines for formulating criteria on how to acquire Thai senators that should be.


          The results of the study showed that 1) the form of a bicameral parliament Different countries rely on different grounds for establishing a Senate as necessary and appropriate, 2) In countries that use a bicameral parliament, there is a tendency to develop democratic forms and methods of acquiring senators. Unlike Thailand, which has changed to return to the cross-selection model. between representatives of various professional groups 3) The method of acquiring senators under the Constitution of the Kingdom of Thailand, B.E. 2560, still has many problems in principle. both the problem of inconsistency with the democratic regime of the appointed senators and the problem of inconsistency with the principle of being representatives of all senators from Cross-Choose between representatives of professional groups running for election 4) Proposed a method for acquiring senators to have a connection with the people There is a wide variety of qualified individuals in the field of occupation. Freedom from political interference by stipulating that members of the Senate of the Kingdom of Thailand come from “Direct elections” of the people by designating the whole country as constituencies. and determine the qualifications of candidates to be elected from a group of representatives of various occupations defined.
