Abstract

            According to copyright law, exclusive rights are of copyright owners, who can solely obstruct or authorize others to use their copyrighted work. Nowadays, it is quite impossible for copyright owners to oversee every possible use of their works due to the advancement of technology permitting easier access to the copyrighted works; it creates difficulty or even negative consequences to the copyright owners. Therefore, collective management of copyright is a pragmatic solution to solve such an issue. The establishment of collective management organizations (CMOs) is crucial since they can effectively assist copyright owners to manage their rights attached to copyrighted works; the world of music can be exemplary to this. There are a large number of CMOs in musical works across the world, including Thailand. Nevertheless, the Copyright Act of Thailand B.E. 2537 even with the recent amendment has no provision relating to CMOs.


            This research emphasizes on studying the significance, functions, and types of copyright collective management and portraying an analysis of the United States and China’s laws and regulations relevant to CMOs of music copyrights compared to Thailand. After conducting thorough research, there are several interesting legal issues with regard to CMOs of music copyrights in Thailand. In addition, the research introduces recommendations, which hopefully will become useful for further legal development of CMOs in Thailand.
