The Imposition of Criminal Liability and Penalties for the Possession of Military Firearms for Commercial Purposes

Abstract
This article aims to examine and analyze the legal issues concerning the determination of criminal liability and penalties for the possession of military firearms for commercial purposes under the Firearms, Ammunition, Explosives, Fireworks, and Imitation Firearms Act B.E. 2490 (1947). The study focuses on legal gaps relating to the elements of the offense, the interpretation of statutory provisions, the proof of criminal intent, and the definition of military firearms. It also provides a comparative analysis of the laws of the United States, Canada, the United Kingdom, Australia, and Singapore in order to propose guidelines for improving Thai legislation and enhancing its effectiveness.
The study found that Thai law provides only the offenses of “possession” and “trading or sale” of military firearms, without specifically establishing the offense of “possession for commercial purposes.” As a result, law enforcement authorities are unable to effectively prosecute offenders at the preparatory stage of criminal conduct. Moreover, under the principle of strict interpretation of criminal law, courts are not permitted to interpret the term “trading or sale” so broadly as to encompass possession for commercial purposes. In addition, proving an intention to possess military firearms for commercial purposes rests entirely on the prosecution, making such intent difficult to establish in practice. Furthermore, the legal definition of military firearms lacks clarity and has not kept pace with technological developments.
It is therefore proposed that the law be amended to establish the offense of possession of military firearms for commercial purposes, provide a clear definition of military firearms, and develop legal mechanisms that facilitate the proof of relevant facts. In addition, penalties should be revised in accordance with the concepts of preventive criminal law, reasonable suspicion, legal presumptions of criminal conduct, and the dangerousness of the offender. Such measures would enable the prevention of criminal activities at an early stage, facilitate the proof of an intention to possess military firearms for commercial purposes, and remain consistent with the presumption of innocence. Although they would impose an evidential burden on the defendant, proving the defendant, proving the defendant’s intention to possess military firearms for commercial purposes is currently the responsibility of the prosecution.
