ประชามติรัฐธรรมนูญใหม่: การจัดลำดับอำนาจรัฐใหม่สู่มาตรฐานสากล

บทคัดย่อ
บทความวิชาการนี้มีวัตถุประสงค์เพื่อ (1) วิเคราะห์ปรากฏการณ์การออกเสียงประชามติในปี พ.ศ. 2569 ในฐานะหมุดหมายสำคัญของการจัดระเบียบโครงสร้างอำนาจรัฐไทยใหม่ (2) ศึกษาสาเหตุความเปราะบางของรัฐธรรมนูญไทยในอดีตผ่านแนวคิดลำดับชั้นของความชอบธรรมและการเปลี่ยนผ่านเชิงสถาบัน และ (3) เสนอตัวแบบการจัดระเบียบอำนาจใหม่สู่มาตรฐานสากล บทความนี้ใช้การทบทวนวรรณกรรมอย่างเป็นระบบและการวิเคราะห์เชิงเปรียบเทียบ โดยบูรณาการแนวคิดสัญญาประชาคม ทฤษฎีอำนาจสถาปนารัฐธรรมนูญ และหลักประชาธิปไตยแบบปรึกษาหารือ ผลการศึกษาพบว่า สภาวะความเปราะบางของรัฐธรรมนูญไทยในอดีตเกิดจากการจัดวางลำดับชั้นความชอบธรรมที่ผิดทิศทางแบบบนลงล่าง บทความนี้จึงเสนอตัวแบบการจัดระเบียบอำนาจใหม่ผ่านกระบวนการ “ฉันทามติมหาชน” โดยใช้สมการการสร้างสมดุลระหว่างจารีตและการปฏิรูป เพื่อเปลี่ยนผ่านรัฐไทยไปสู่การเป็นรัฐที่ยึดโยงกับสิทธิอำนาจทางหลักการและมาตรฐานสากล นำไปสู่การร่างรัฐธรรมนูญที่เป็นสัญญาประชาคมอย่างแท้จริง ผลการสังเคราะห์เชิงทฤษฎีนำไปสู่การนำเสนอ “ตัวแบบสถาปัตยกรรมแห่งอำนาจรัฐใหม่” ที่ประกอบด้วย 4 เสาหลัก ได้แก่ ความสามารถในการวิพากษ์ การมีส่วนร่วมที่หลากหลาย การใช้เหตุผลสาธารณะ และพื้นที่เห็นต่างอย่างปลอดภัย
