บทคัดย่อ
งานวิจัยฉบับนี้ มุ่งศึกษา วิเคราะห์หลักการ แนวความคิดตามพระราชบัญญัติคุ้มครองพันธุ์พืช พ.ศ.2542 เพื่อนำมาวิเคราะห์ว่าหลักการและแนวทางตามพระราชบัญญัติคุ้มครองพันธุ์พืชฯ มีความเหมาะสมสอดคล้องกับหลักการตามอนุลัญญาว่าด้วยความหลากหลายทางชีวภาพหรือไม่ และหากมิได้บัญญัติพระราชบัญญัติดังกล่าวให้เหมาะสมและสอดคล้องกับหลักการ แนวความคิดตามอนุลัญญาว่าด้วยความหลากหลายทางชีวภาพจะเป็นสาเหตุหนึ่งที่ทำให้เกิดปัญหาการบังดับใช้พระราชบัญญัติคุ้มครองพันธุ์พืชฯตามมาตรา 52 หรือไม่ จากการศึกษา พบว่า หลักการ แนวความคิดตามพระราชบัญญัติคุ้มครองพันธุ์พืชฯ มาตรา 52 นั้นไม่สอดคล้องกับ หลักการ แนวความคิดตามอนุลัญญาว่าด้วยความหลากหลายทางชีวภาพ เพราะพระราชบัญญัติ คุ้มครองพันธุ์พืชฯ นำหลักการ แนวความคิดของการคุ้มครองพันธุ์พืชพื้นเมืองทั่วไปและพันธุ์พืชป่า ซึ่งมีหลักการ แนวความคิดและการบริหารจัดการทรัพยากรพันธุ์กรรมพืชที่แตกต่างกับหลักการ แนวคิด การบริหารจัดการพันธุ์พืชใหม่ มารวมอยู่ในพระราชบัญญัติคุ้มครองพันธุ์พืช ซึ่งเป็นปัญหาสำคัญประการหนึ่งที่เป็นสาเหตุให้เกิดปัญหาการบังดับใช้พระราชบัญญัติคุ้มครองพันธุ์พืช มาตรา 52 สำหรับข้อเสนอแนะมีสองประการคือ 1)การบริหารจัดการพันธุ์พืชพื้นเมืองทั่วไปและ พันธุ์พืชป่าควรแยกออกจากพระราชบัญญ้ติคุ้มครองพันธุ์พืชฯ และ 2)การบริหารจัดการทรัพยากร พันธุ์กรรมพืชดังกล่าวนี้ ควรนำมาบริหารจัดการโดยองค์กรประสานงานกลาง หรือศูนย์บริหารจัดการฯ ภายใต้กฎหมายว่าด้วยความหลากหลายทางชีวภาพ
