Considerations for Exemption from Personal Data Protection Laws: A Case Study of UK Laws

Abstract
The concept of personal data protection aims to protect the privacy rights of people in order to not to be harassed in accessing, using, collecting and as well as storing such information under the right to privacy without interference and interference from society. The Personal Data Protection Act B.E. 2562 is enacted to put in place measures to protect the rights of personal data that any person will access, use, collect and store information of any person must obtain the consent of the owner. In some cases, it is necessary to be exempt from the consent process by reason and absolute necessity. As an exception enacted in Section 4 of the Act.
However, exemption cases are essential, as the federal law should provide guidelines for dealing with personal data without fulfilling the requirements of the Act. From the study, it was found that there is no clear guideline in the Act regarding the measures that any state authority or persons who are exempted under Section 4 to have any duty or processed to prevent from wrongdoing. A study of The Investigatory Powers Act 2016 and The Data Protection Act, UK law found a preliminary orientation. To prevent reliance on legal exceptions to misuse personal data. The researcher believes that this study will lead to the creation of a guideline to develop a central law to better protect personal data.
