Abstract

              Thisstudy aims to upbringing how todevelop the punishment for motorists while drunkThat is appropriate for the offender and the seriousness of the offense in each case with a qualitative study from textbooks, documents on criminal convictions for drunk driving in Thailand and abroad including the United States, England and Japan, as well as interviewing the opinions of 8 experts in the judicial process consisting of police, lawyers, public prosecutors and the judge


              The study found that the guidelines for the development of punishment for motorists while drunk should use a high rate penalty as a base to punish those driving while drunk. The imprisonment of a prison without waiting for punishment should be used with a very serious offense and must be classified at the seriousness of the crime so that the court can use the discretion to impose a fine or imprisonment appropriately.In addition, alternative measures should be used instead of imprisonment and administrative measures, along with the main punishment to allow offenders to change their attitude and driving behavior of driving while drunk
