บทคัดย่อ
บทความนี้เป็นการสรุปเนื้อหาของวิทยานิพนธ์ เรื่อง การจดทะเบียนแบบผลิตภัณฑ์ อุตสาหกรรมเพียงบางส่วน โดยมีวัตถุประสงค์ เพื่อศึกษาถึงปัญหาและอุปสรรคในการจดทะเบียนแบบผลิตภัณฑ์อุตสาหกรรมโดยขอถือสิทธิเพียงบางส่วนของแบบผลิตภัณฑ์อุตสาหกรรม ภายใต้พระราชบัญญัติสิทธิบัตร พ.ศ. 2522 รวมไปถึงกฎกระทรวง ประกาศกรมทรัพย์สินทางปัญญาที่เกี่ยวข้อง และศึกษาเปรียบเทียบกับระบบกฎหมายเกี่ยวกับการจดทะเบียนแบบผลิตภัณฑ์โดยขอถือสิทธิเพียงบางส่วนของแบบผลิตภัณฑ์อุตสาหกรรมของต่างประเทศ ได้แก่ สหรัฐอเมริกา และประเทศญี่ปุ่น ซึ่งเป็นประเทศที่อนุญาตรับจดทะเบียนแบบผลิตภัณฑ์ อุตสาหกรรม โดยขอถือสิทธิเพียงบางส่วนของแบบผลิตภัณฑ์อุตสาหกรรม โดยมุ่งศึกษาเปรียบเทียบเกี่ยวกับการแสดงภาพแสดงแบบผลิตภัณฑ์ การระบุข้อถือสิทธิ และส่วนประกอบอื่น ๆ ที่สำคัญ ในการการจดทะเบียนแบบผลิตภัณฑ์โดยขอถือสิทธิเพียงบางส่วนของแบบผลิตภัณฑ์ อุตสาหกรรม
จากการศึกษาพบว่า การจดทะเบียนแบบผลิตภัณฑ์อุตสาหกรรมภายใต้พระราชบัญญัติสิทธิบัตร พ.ศ. 2522 และกฎหมายอื่นที่เกี่ยวข้องในประเทศไทย ผู้ขอรับสิทธิบัตรจะต้องจดทะเบียนโดยขอรับความคุ้มครองทั้งตัวแบบผลิตภัณฑ์อุตสาหกรรมเท่านั้น โดยภาพแสดงแบบผลิตภัณฑ์ชนิดรูปเขียน จะต้องใช้เส้นเรียบ มีความหนาเท่ากันโดยตลอดและไม่ขาดจากกัน และระบุข้อถือสิทธิโดยขอถือสิทธิในแบบผลิตภัณฑ์ ได้แก่ รูปร่าง ลักษณะ ลวดลาย หรือสีของแบบผลิตภัณฑ์ โดยไม่สามารถระบุข้อถือสิทธิโดยสละสิทธิบางส่วนของแบบผลิตภัณฑ์อุตสาหกรรมได้
ดังนั้น เพื่อให้สามารถจดทะเบียนแบบผลิตภัณฑ์อุตสาหกรรมโดยขอถือสิทธิเพียงบางส่วนของแบบผลิตภัณฑ์อุตสาหกรรมได้ในประเทศไทย ผู้เขียนจึงเสนอให้ปรับปรุงแก้ไขเพิ่มเติมพระราชบัญญัติสิทธิบัตร พ.ศ. 2522 เกี่ยวกับความหมายของคำว่า “แบบผลิตภัณฑ์” ให้รวมถึงส่วนใดส่วนหนึ่งของแบบผลิตภัณฑ์ และแก้ไขปรับปรุงรายการประกอบคำขอรับสิทธิบัตรการออกแบบผลิตภัณฑ์ที่สำคัญ และกฎกระทรวงที่เกี่ยวข้อง เกี่ยวกับเส้นที่ใช้ในการเขียนภาพแสดง แบบผลิตภัณฑ์อุตสาหกรรม และการระบุข้อถือสิทธิ
