มาตรการทางกฎหมายเกี่ยวกับการทำงานทางไกล

บทคัดย่อ
บทความวิจัยนี้ มีวัตถุประสงค์เพื่อศึกษาเปรียบเทียบ “มาตรการทางกฎหมายเกี่ยวกับการทำงานทางไกล” ในสามประเทศ ได้แก่ ประเทศไทย ประเทศโปรตุเกส และประเทศสเปน จากการศึกษา พบว่า ทุกประเทศมีกฎหมายเกี่ยวกับการทำงานทางไกล แต่ละประเทศกำหนดมาตรการเพื่อคุ้มครองลูกจ้างที่ทำงานทางไกลคล้ายกันและแตกต่างกันไป สำหรับประเทศไทย มาตรา 23/1 พระราชบัญญัติคุ้มครองแรงงาน พ.ศ. 2541 บัญญัติเรื่องการทำงานนอกสถานประกอบกิจการของนายจ้างหรือนอกสำนักงานของนายจ้าง ผู้วิจัยจึงขอเสนอแนะเพื่อเป็นแนวทางในการเพิ่มความคุ้มครองและให้ประโยชน์แก่ลูกจ้างที่ทำงานทางไกล ได้แก่ (1) การมีบทบัญญัติเกี่ยวกับเครื่องมือ อุปกรณ์ ระบบ และวิธีการทำงาน ในการทำงานทางไกล (2) การมีบทบัญญัติเกี่ยวกับความเป็นส่วนตัวของลูกจ้าง (3) การมีบทบัญญัติเกี่ยวกับสิทธิและหน้าที่เป็นพิเศษของนายจ้างและลูกจ้างที่เกิดขึ้นจากการทำงานทางไกล หากได้มีการแก้ไขเพิ่มตัวบทบัญญัติตามที่กล่าวมาข้างต้นจะช่วยคุ้มครองลูกจ้างและก่อให้เกิดความเป็นธรรมแก่สังคม
