บทคัดย่อ
บทความวิจัยฉบับนี้ มีวัตถุประสงค์สำคัญเพื่อศึกษามาตรการทางกฎหมายในการคุ้มครองข้อมูลส่วนบุคคลที่เหมาะสมสำหรับประเทศไทย โดยเฉพาะในกรณีที่ต้องมีการโอนข้อมูลส่วนบุคคลระหว่างประเทศเพื่อคุ้มครองสิทธิในความเป็นส่วนตัวของเจ้าของข้อมูลส่วนบุคคล โดยมุ่งศึกษาแนวทางการโอนข้อมูลส่วนบุคคลระหว่างประเทศตามกรอบความตกลงระหว่างประเทศที่มีลักษณะเป็น Soft Law คือ OECD Privacy Framework และ APEC Privacy Framework รวมทั้งความตกลงระหว่างประเทศที่มีลักษณะเป็น Hard Law ทั้งความตกลง ระดับพหุพาคีและทวิภาคี ซึ่งได้แก่ The EU General Data Protection Regulation (GDPR) และ The EU-U.S. Privacy Shield รวมทั้งตัวอย่างมาตรการทางกฎหมายในการคุ้มครองข้อมูลส่วนบุคคลของประเทศในอาเซียน คือ สิงคโปร์ เพื่อให้เห็นแนวปฏิบัติที่แตกต่างกัน ซึ่งจะเป็นประโยชน์ต่อการจัดทำข้อเสนอแนะสำหรับประเทศไทยในการจัดทำมาตรการทางกฎหมายเพื่อการคุ้มครองข้อมูลส่วนบุคคลให้ได้มาตรฐานทัดเทียมนานาอารยประเทศต่อไป
