การอนุวัติการกฎหมายว่าด้วยการคุ้มครองมรดกโลกทางวัฒนธรรมและทางธรรมชาติของประเทศไทย

บทคัดย่อ
บทความนี้ มีวัตถุประสงค์เพื่อศึกษาสาระสำคัญของอนุสัญญาว่าด้วยการคุ้มครองมรดกโลกทางวัฒนธรรมและทางธรรมชาติ ค.ศ. 1972 ประกอบกับเอกสารแนวทางการอนุวัติตามอนุสัญญาคุ้มครองมรดกโลก และการอนุวัติการและการบังคับใช้กฎหมายว่าด้วยการคุ้มครองมรดกโลกทางวัฒนธรรมและทางธรรมชาติของประเทศไทย ในฐานะที่ประเทศไทยเป็นภาคีอนุสัญญาดังกล่าว
จากการศึกษา พบว่า ประเทศไทยมีกฎหมายระดับพระราชบัญญัติใช้บังคับในการคุ้มครองมรดกทางวัฒนธรรมและทางธรรมชาติอยู่หลายฉบับ ส่งผลให้เกิดปัญหา 2 ประการ คือ (1) ปัญหาการบังคับใช้กฎหมายภายในประเทศกับการคุ้มครองมรดกโลกของประเทศไทย และ (2) ปัญหาการทับซ้อนของหน่วยงานของรัฐในการคุ้มครองมรดกโลกของประเทศไทยในการคุ้มครองมรดกโลกทางวัฒนธรรม บทความนี้จึงได้เสนอแนวทางแก้ไขปัญหาดังกล่าว โดยนำหลักกฎหมายของสาธารณรัฐอิตาลีมาเป็นแนวทางการปรับปรุงมาตรการทางกฎหมาย
ผู้เขียนมีข้อเสนอแนะ คือ ควรแก้ไขเพิ่มเติมพระราชบัญญัติโบราณสถาน โบราณวัตถุ ศิลปวัตถุ และพิพิธภัณฑสถานแห่งชาติ พ.ศ. 2504 ในการกำหนดหน่วยงานผู้รับผิดชอบหลักและการบูรณาการการทำงานร่วมกันของหน่วยงานที่เกี่ยวข้อง การประเมินผลกระทบสิ่งแวดล้อม (EIA) การส่งเสริมการมีส่วนร่วมของประชาชนและองค์กรปกครองส่วนท้องถิ่น และกำหนดบทลงโทษทางแพ่งและทางอาญา
