บทคัดย่อ
ร่างพระราชบัญญัติความหลากหลายทางชีวภาพเป็นความพยายามของรัฐที่ต้องการ บัญญ้ติกฎหมายใหม่ เพื่อส่งเสริมให้เกิดการอนุรักษ์ การเข้าถึงและการแบ่งปันผลประโยชน์ อันเกิดจากการใช้ทรัพยากรชีวภาพ ทรัพยากรพันธุกรรมและความหลากหลายทางชีวภาพ อย่างยั่งยืนในประเทศไทย ดังนั้น เพื่อให้เกิดประสิทธิภาพและประสิทธิผลสูงสุดในการบริหาร จัดการทรัพยากรดังกล่าว ผู้เขียนมีข้อเสนอแนะหลักๆ 3 ประการคือ (1) (ร่าง) กฎหมายฉบับนี้ ต้องบัญญัติขึ้นมาเป็นกรอบการดำเนินการ เพื่อให้กฎหมาย นโยบายและการบริหารจัดการที่ เกี่ยวข้องกับทรัพยากรดังกล่าวเป็นไปในทิศทางเดียวกัน (2) องค์กรกลาง ต้องเป็นองค์กรอิสระ หรือองค์กรมหาชนที่มีศักยภาพควบคุม กำกับ ติดตาม ตรวจสอบกฎหมาย นโยบายและการ บริหารจัดการดังกล่าวให้อยู่ภายใต้ บทบัญญัติตาม (ร่าง) กฎหมายฉบับนี้ และ (3) ประชาชน และชุมชนในพื้นที่ต้องมีศักยภาพในการบริหารจัดการทรัพยากรในพื้นที่ในลักษณะกำกับดูแล ตนเองได้
