Legal Problem Concerning Coastal Land Reclamation: A Case Study of the Maptaphut Industrial Terminal in Rayong Province

Abstract

Coastal land reclamation is a procedure to increase the land for accommodating with the populations including using the area for various constructions for economic development, as well as extending the sea base line. Therefore, the marine environment and ecosystems along the coast were immediately damaged as the coastal land reclamation affect to natural changes extremely. As the Law of the Sea has not been directly legislated about coastal land reclamation, its disputes settlement procedure cannot resolve these occur problems. The Research suggests for amending the coastal land reclamation law and regulations by adding the rule for protecting and preserving the marine environment. The liability for damages by injured person, compulsory settlement of disputes as part of the rule for compensation and remedies should also be provided to be enforced strictly.
