บทคัดย่อ
บทความฉบับนี้ มีวัตถุประสงค์ในการศึกษา (1) ผู้สืบทอดองค์ความรู้ (2) การสงวนรักษามรดกทางวัฒนธรรมที่จับต้องไม่ได้ตามอนุสัญญาว่าด้วยการสงวนรักษามรดกทางวัฒนธรรมที่จับต้องไม่ได้ ค.ศ. 2003 (Convention for the Safeguarding of the Intangible Cultural Heritage 2003) และ (3) การส่งเสริมและรักษามรดกภูมิปัญญาทางวัฒนธรรม ตามพระราชบัญญัติส่งเสริมและรักษามรดกภูมิปัญญาทางวัฒนธรรม พ.ศ. 2559 เพื่อนำไปสู่การศึกษาเปรียบเทียบสิทธิของผู้สืบทอดองค์ความรู้ตามพระราชบัญญัติส่งเสริมและรักษามรดกภูมิปัญญาทางวัฒนธรรม พ.ศ. 2559 และอนุสัญญาว่าด้วยการสงวนรักษามรดกทางวัฒนธรรมที่จับต้องไม่ได้ ค.ศ. 2003 เพื่อเป็นประโยชน์ในการแก้ไขเพิ่มเติมพระราชบัญญัติส่งเสริมและรักษามรดกภูมิปัญญาทางวัฒนธรรม พ.ศ. 2559 ในสิทธิของผู้สืบทอดองค์ความรู้ที่นำไปสู่การพิทักษ์สิทธิของผู้สืบทอดองค์ความรู้อย่างเป็นรูปธรรมมากยิ่งขึ้น ผลการศึกษาพบว่า พระราชบัญญัติส่งเสริมและรักษามรดกภูมิปัญญาทางวัฒนธรรม พ.ศ. 2559 ยังไม่เพียงพอต่อการปกป้องสิทธิของผู้สืบทอดองค์ความรู้เมื่อศึกษาเปรียบเทียบกับอนุสัญญาว่าด้วยการสงวนรักษามรดกทางวัฒนธรรมที่จับต้องไม่ได้ ค.ศ. 2003 (CONVENTION FOR THE SAFEGUARDING OF THE INTANGIBLE CULTURAL HERITAGE 2003) จึงควรแก้ไขเพิ่มเติมพระราชบัญญัติส่งเสริมและรักษามรดกภูมิปัญญาทางวัฒนธรรม พ.ศ. 2559 ในประเด็นของคำนิยามคำว่า ผู้สืบทอดองค์ความรู้ สิทธิเปลี่ยนแปลงและพัฒนาองค์ประกอบในองค์ความรู้ของมรดกภูมิปัญญาทางวัฒนธรรม สิทธิในการมีส่วนร่วมในการส่งเสริมและรักษามรดกภูมิปัญญาทางวัฒนธรรม และสิทธิในการยับยั้งการกระทำที่ก่อให้เกิดความเสียหายกับมรดกภูมิปัญญาทางวัฒนธรรม
