วิวัฒนาการของความคิดว่าด้วยกฎหมายในพม่าและสยาม

บทคัดย่อ
เมื่อกล่าวโดยรวมในบริบทแห่งงานทางวิชาการของศาสตราจารย์ ร. แลงกาต์ หรือ โรแบรต์ แลงกาต์ (Robert Lingat) แล้ว ปาฐกถาในหัวข้อ “วิวัฒนาการของความคิดว่าด้วยกฎหมายในพม่าและสยาม” แสดงต่อที่ประชุมสยามสมาคม เมื่อวันพุธที่ 9 มีนาคม พ.ศ.2492 นี้ นับเป็นความพยายามของนักประวัติศาสตร์กฎหมายชาวฝรั่งเศสคนสำคัญในการทำความเข้าใจแนวความคิดพื้นฐานทางนิติศาสตร์ที่ได้รับอิทธิพลจากพุทธคติแบบเถรวาทที่ปรากฏในดินแดนเอเซียตะวันออกเฉียงใต้ภาคพื้นทวีป ซึ่งเป็นที่รู้จักกันในคริสต์ศตวรรษที่แล้วในนาม “ดินแดนแห่งรัฐที่ได้รับอิทธิพลจากอารยธรรมอินเดีย”
ในเนื้อหาของปาฐกถา ศาสตราจารย์ โรแบรต์ แลงกาต์ พยายามวิเคราะหว์ว่าประเทศสยามและพม่าก็เป็นดินแดนที่รับอิทธิพลจากอารยธรรมอินเดียด้วยเช่นกัน แต่ลักษณะที่ต่างออกไปก็คือ ทั้งสองประเทศนี้ได้รับคติพุทธศาสนาแบบเถรวาท มิใช่คติศาสนาโบราณดั้งเดิมของอินเดียเช่นที่ โรแบรต์ แลงกาต์ มักเรียกว่า ศาสนาฮินดูแต่อย่างใด การตรวจสอบข้อเท็จจริงในประเด็นนี้จึงมุ่งไปยังหลักฐานทางประวัติศาสตร์เป็นลายลักษณ์อักษรซึ่งยังคงหลงเหลืออยู่ต่อมาจนถึงในขณะทำการศึกษา โดยเฉพาะอย่างยิ่งบรรดาวรรณกรรมทางกฎหมายของชาวพม่าที่เรียบเรียงขึ้นในสมัยต่างๆ รวมถึงวรรณกรรมทางกฎหมายที่เป็นผลงานของชาวมอญที่มีมาก่อนหน้า และจบเนื้อหาการปาฐกถาด้วยการวิเคราะห์ประเด็นเดียวกันสำหรับประเทศสยามในเวลานั้น เมื่อกล่าวสำหรับนักเรียนและผู้สนใจในความรู้ด้านประวัติศาสตร์กฎหมายไทยในปัจจุบัน ปาฐกถาของศาสตราจารย์ ร. แลงกาต์ ชิ้นนี้ นับเป็นองค์ความรู้สำคัญ อันจะขาดเสียมิได้ซึ่งจะช่วยหนุนเสริมทั้งในด้านข้อมูลและการวิเคราะห์ประวัติศาสตร์กฎหมายไทยให้แน่นแฟ้นยิ่งขึ้นหากจะได้ผ่านการศึกษาและทำความเข้าใจตำราชุดประวัติศาสตร์กฎหมายไทยของ ร. แลงกาต์ โดยเฉพาะอย่างยิ่ง “เล่ม 1 ข้อความเบื้องต้น” มาแล้ว
